The Supreme Court has dismissed a plea by Prashant Barman, the former Rajganj block development officer, after he failed to comply with the Calcutta High Court’s direction to surrender in the kidnapping and murder case of gold trader Swapan Kamillya. The court directed the state to immediately implement the High Court’s order.

High Court gave 48 hours to surrender

The Calcutta High Court directed Barman last Tuesday to surrender within 48 hours. He was expected to surrender by last Thursday. The High Court had also ordered that his property be seized and his salary stopped if he did not surrender.

Instead of complying with the direction, Barman challenged it before the Supreme Court. The case came up before the court on Tuesday.

State told to act immediately

A bench of Justice Aravind Kumar and Justice Vipul M. Pancholi dismissed Barman’s plea and asked the state to take immediate action in accordance with the High Court’s direction. During the hearing, the Supreme Court said, “One person has left the entire system in ridicule.”

The court also said, “What are you doing? Act now in accordance with the High Court’s direction.” The Supreme Court observed that its earlier direction had also not been followed.

CID is investigating the case

The CID took over the investigation into the alleged kidnapping and murder of gold trader Swapan Kamillya in Dattabad, Bidhannagar, last July. An arrest warrant has been issued against Barman, but he could not be arrested. He was also alleged to have continued receiving his salary.

The CID’s role came under question during a hearing in the Calcutta High Court on September 10. Justice Tapabrata Chakraborty said, “An arrest warrant has been issued against the BDO, yet the CID says he cannot be found. Why is the government not alert?”
